Know to all men by these presents that where Thomas Arthur late ofBedf ord County in the State of Virginia Deceased by his last will &testame nt in writing did gi ve & bequeath at unto nor Frances Prestonof Lawre nce County & State of Kentucky, a legacy to be paid unto meof the said w ill made and entrusted Moses Leftwich and David W.Quarles (Justice of t he Peace for Bedford County) of the County &State aforesaid bound Exec utors as in and by the said will may appearexecutrix. Know yea that I s aid Frances Preston have made andawarded, constituted, and Stephen Pre ston of Lawrence County & Stateof Kentucky my True & Lawful Attorney f or me and in my name and formy will proper unto and Benefit to ask Dem and & receive of & forwardthe said will of the said Arthurs as aforesa id and upon receiptthereof by or payment thereof to my said attorney a g eneral releaseor discharge for the same to make Execute and deliver he rebyratifying an d confirming and allowing whatsoever ny said Attorney shall lawfully do in the presences. On this 9th, day of September one thousand eight hundred and fortythre e personally appeared before me the undersigned, a Justice of thePeace f or the County aforesaid, Fanny Preston, a resident of thecounty of Law rence and State of Kentucky, aged seventy nine years whobeing first du ly sworn according to law doeth on her oath make thefollowing declarat ion in order to obtain her benefit of theprovisions made by an Act of C ongress passes July 7, 1838 entitled“An Act granting half pay and pens ions to certain widows”.
That she is the widow of Moses Preston, who was a private in the armyo f the Revolution who entered the service sometime in the Spring timeye ar, she thinks in the year 1780, he entered the service as asubstitute i n the place of William Hallegin as a private. That herhusband was in t he service as so considered from the time he firstentered the service t ill the close of the war.
That he resided in the county of Bedford Virginia when he entered thes ervice under Col. Campbell who commanded the 7th Virginia Regimentof I nfantry.
His Captain was by the name of Bowyer, she states that she does notkno w of any battles but has heard him say that he was in the battleof Cam den. He was engaged, she heard him say in the guarding thehouse and pr operty of Genl. Huges at the time of this time of thebattle of Intaid S prings.
She states that she has no documenting evidence in her possession buts upposes that the original discharge of her husband is on file withhis a pplication for pension she states that was on the pension roll.
She further reclaims that she was married to said Moses Preston on then inth day of July seventeen hundred and eighty three and that herhusban d the aforesaid Moses Preston died on the eighteenth day ofApril eight een hundred and forty two.
That she was not married to him to his being in the service but themar riage took place previous to the first of January seventeenhundred and n inety-four viz at the time above states.
