Appendix C - Will of Lieut. Edward Ware

In the Name of God, Amen.

I, Edward Ware of the County of Madison and thesta te of Georgia being far advanced in years, and somewhat infirm,yet per fect in mind and memory, blessed be God, and knowing that itis appoint ed for all men once to die do make and ordain this to be mylast will a nd testament. In the first place I recommend my soul toGod, and my bod y to the earth, that gave it, not doubting but at theday of the genera l resurrection I shall receive the same, to beburied in a decent Chris tian like manner at the discretion of myexecutors.
And as touching such worldly estate as it hath pleased Almighty God toe ndow me with I dispose of it in the following manner----

Item, My eldest son Bennet Ware, having providedfo r by a tract of land which I gave him on Lamars Creek, a Negro boyname d Lewis, a gray mare and saddle and some other property towardshouseke eping. My will is that he receive nothing more from my estate,except h is part of the surplus that may be left after taking out alllegacies h ereinafter expressed.

2nd. My daughter Lettice Ware has received a negrob oy named Joe, a boy mare and saddle and other property towardshousekee ping. My will is that she receive nothing more out of myestate except a s hereinafter
expressed.

3rd. Judith Higginbotham my daughter in her lifeti me received a negro boy named Charles, a black mare and saddle,etc. My w ill is that she nor her children receive nothing more out ofmy estate.

4th. My son Philip Ware has received a tract oflan d containing one hundred and thirty-three acres of land out of thetrac t I now live on, he has also reeived a negro boy called Abraham,a gray m are and saddle, etc. My will is that he receive nothing moreout of my e state except his part of the surplus as expressed in thefirst item.

5th. My son Henry Ware in his life time receivedon e hundred and forth-three acres of land to which I made him title,a ne gro boy called Cato, a gray mare and saddle, etc. My will is thathis h eirs receive nothing more out of my estate except theproportionate par t of the surplus as aforesaid.

6th. My daughter Elizabeth Long has received anegr o girl named Dice and one hundred dollars in place of a horse andsaddl e. It is my will that she receive twenty dollars more out of myestate i n place of property heretofore given the rest of my children,it is my w ill that she receive nothing more except as hereinafterexpressed.

7th. My daughter Mary Hobson has received a negrog irl called Easter, a gray mare and saddle, etc. My will is that sherec eive nothing more except as hereinafter expressed.

8th. My daughter Sarah Borum has received a brownm are, saddle, etc. I now give to her during her natural lifetime anegro g irl Silvey and her children and her future increase, and ather death t o descend to and belong to all the children of my saiddaughter Sarah B orum, including the two children she has by her firsthusband Britton S anders, and to prevent this gift from beingdefeated, I hereby make my e xecutors trustees to hold the said negrogirl, her children and her fut ure increase in trust to carry thisgift into effect. My will is that s he receive nothing more except ashereinafter expressed.

9th. My daughter Ann Higginbotham in her life timer eceived a negro girl called Peggy, a horse, a saddle, ect. My willis t hat she nor her estate receive nothing more of my estate.

10th. I give to my son Elisha Ware, all the land In ow own in Madison County, it being land where I now live and wheremy s on Elisha now lives, with this condition, that he pay to mydaughters L ettice Ware, Elizabeth Long, Mary Hobson, Sarah Borum, andGinny Strick land fifty dollars ($50.00) each. I also give him a negroboy called Si mon, which he has in his possession, it is also my willthat he receive a h orse to the value of one hundred dollars, or onehundred dollars in cas h, nothing further out of my estate except hispart as before expressed i n the first item.

11th. My daughter Gincy Strickland has received an egro girl called Rhoda, a bay horse, saddle etc. But she receivesnothi ng more except hereinafter expressed.

12th. I also gave my five daughters, to-wit,Lettic e Ware, Elizabeth Long, Mary Hobson, Sarah Borum, and GincyStrickland n ine hundred and eighty acres of land in Wayne Countygranted to myself.

13th. And lastly my will is that all my estate ofw hatsoever kind not herein disposed of shall constitute a generalsurplu s and shall be equally divided between my son Bennett Ware, mydaughter L ettice Ware, Philip Ware, Henry Ware, Legalrepresentatives, Elizabeth L ong, Mary Hobson, Sarah Borum, ElishaWare and Ginny Strickland, or the ir children in case either of theabove named be dead. I hereby appoint J ames Long, Philip Ware andElisha Ware, executors of this my last will, h ereby revoking allformer wills by me at any time made.

In testimony whereof I have hereunto set my handan d sealed this eight day of December in the year of our Lordeighteen hu ndred and thirty seven.
