Trouble on the home front:

To the honorable the judge of the Mercer Circuit Court in Chancery,the p resentation? of your oratrix, Sarah Powell, humbly complainingto your h onor herewith that about forty years ago she unfortunatelyintermarried w ith a certain Charles Powell in the Commonwealth ofVirginia by a marri age solemnized according to the then existing lawsof that state. That s he was at that time possessed of and investedwith in her own right, on e hundred acres of land in SpotsyvaniaCounty and afterwards received a t the death of her father a legacy ofpersonal estate and a female slav e. She further states that at thetime of the marriage ? the said Powel l had no real estate and nopersonal estate except a horse and wearing a pparel nor has he everreceived to her knowledge and belief to the amou nt of 20 S. from anyrelation or by any legacy in donation whatever. Sh e further statesland aforesaid? has been long since sold and from the p roceedsthereof and from the increase of the Negro aforesaid? the estat e ofsaid Powell hath accrued and negroated?? Your oratrix states that many years after the marriage aforesaid the said Deft. treated her withc ustomary tenderness and affection and she states that she hasuniformit y treated him with that perfect? and affection which moraland social d uty enjoined in her as a wife. But about four years agothe affection o f the said Powell without any provocation on her partbecame alienated f rom your orartix and he has since treated her withcruelty and indignit y which no patience could bear and whichhumanity? never ought to be su bjected to. Your oratrix expresslycharges that he has given her every r eason to believe and she doesbelieve that he has long lived in a state o f fornication withnegroess slaves, that he has indulged himself in her p resence withevery dalliance short of fornication with her female salve s for morethan eight months now. She expressly charges that he has rep eatedlybeaten her with his fists and with sticks in a cruel and unmerc ifulmanner so as to endanger her life. That he has once attempted to smother her to death. That he is in the practice of dispersing theestat e to which she has certainly in ? a claim equal to his and haslately b artered away a very valuable negro man at a vast under valuefor the pu rpose of possessing a negro girl as your oratrix readilybelieves for t he use of prostitution. And in the mean time hasrefused to your oratri x the necessities of life, has banished herfrom his house and advertis ed her with a probation against any persondealing? with her. She furth er states that the said Charles has atthis time the following property T o Wit Track of land whereon he nowresides in the County of Mercer cont aining upwards of one hundredacres, one negro by the name of Tom, one n egro woman by the name ofLiddy, one other by the name of Doray, one ne gro boy by the name ofJeffery, one by the name of Jorden, one negro gi rl by the name ofMirah, one negro boy by the name of Tony which is now i n thepossession of Nimrod Greenwood and that a certain William Hall is indebted to the said Charles in a large sum of money but the particulara mount is not ascertained by her, (and a bond for 400 acres on oneowing ). She further states that the Deft. Charles is also in thepossession a nd hath a right to valuable stocks of every kind To WitHorses, Cows, H ogs, Sheep, and household furniture. She states thatshe and said Charl es hath eight children all of whom are of full ageand married and left t heir parents. She states that the Deft. Charleshath at different times a nd not long since beat and abused her withgreat cruelty and inhumanity a nd without any reasonable orjustifiable cause and that he hath driven h er from his bed and boardand refuseth to make any kind of provision fo r her or in any way toafford her any relief or protection altho the De ft doth well knowestin equity he ought to furnish her with a reasonabl e alimony orsupport but now so it is and may it please your honors tha t he DeftCharles is almost constantly in a state of intoxication and m akingimprudent? and losing bargains to the great injury of his estate a ndat other times he gives it out in speeches that he will either sell his property and leave the state in a short time taking the proceeds oft he sale with him, or that he will leave the state and take his negrowi th him and sale of the land to the end to defraud your oratrix ofher a limony or support. All which actings and doings of the Deft. andhis co nfederates are contrary to equity and justice and intended todefraud a nd injure your oratrix in this behalf. In tenderconsideration in hereo f and for as much as your oratrix is remidless?in the premisses by the s trict rules of the common law and can onlyfind relief in the honorable c ourt of Chancery where matters of thiskind are properly heard and reli ef ? to the end therefore thatjustice may be done in the behalf she pr ays that the Deft. may becompelled to answer this bill and each allega tion thereof on hiscorporal oath, in as full and complete manner as if t he same was hereagain ? and interrogated. And she prays that by your d ecree to bepronounced herein, that the said defendant may be decreed t o allowyour oratrix her alimony or make such provision for her support o nthe equity of the case may require, and she prays of your honors yourC ommonwealth writ of subpena to compel an answer hereto and yourcommonw ealths writ of injunction to restrain and enjoin the saiddefendant fro m selling or in any disposing of the said tract of landwhereon he now r esides and from selling or in any way dispossessingof the said negro o r any of them To Wit Negro Tom, Liddy, Jeffery,Jorden, Miriah, Dorah, a nd Tony until the further order of the Deft.from leaving this state un til the further order of this court andtaking with him the said negro c ase can be heard by your honors, andshe prays such other and further r elief to the equity of her case mayentitle her to and she ? duty bound w ill pray. Article of agreement entered into this 13th day of August 1807 betweenC harles Powell Senior of the county of Mercer of the one part andJer. B riscoe of the county the other part witnesseth that whereassome unhapp y differences has taken place between me Charles Powelland my wife Sar ah Powell which is the cause of her seeking protectionamongst her chil dren and her neighbors and in order that our disputesmay come to a fin al issue and all matters adjusted between us andbelieving it to be a d uty I owe to my wife as she has equally withmyself bore the heat of th e day in procuring the title property wenow possess which she has not o nly the right to claim from herservices rendered but from her possessi ng a considerable part whenshe intermarried with me and as she is now f ar advanced in years andvery infirm and wishing her welfare and also t o manifest to the worldmy upright intentions and in order that she may b e well provided for.I covenant and agree and by those present do bind m yself and heirs inthe penal sum of six hundred pounds to deliver to Je remiah Briscoeand to secure the same by a proper bill of sale five Neg roes, to wit,Lid, a black woman 27 years old and Tony, Jeff, Jordain, a nd Mirah,children of said black woman except Tony, also the one half o f mystock of cattle, sheep and hogs and the whole of the kitchen furniture, twenty barrels of indian corn to be paid next fall. Also oneroan m are and two yearling colts, each bridled with a stirrup cross?, also o ne feather bed which she now has in her possession, all andevery speci es of the aforesaid property. I do bind myself to warrantto aforesaid J eremiah Briscoe and his heirs and for and inconsideration of the said p roperty the said Briscoe doth bind himselfin the penal sum of six hund red pounds to pay to Sarah Powell thelawful interest due yearly on the s um of one thousand dollars and thesum of ten dollars part of the princ ipal and what ever shall remainof the principal at the death of Sarah P owell to be paid to anyperson or persons she may by will authorize to r eceive it in eighteenmonths after her death with lawful interest due t herein and if itshould so happen that the said Sarah Powell should fai l to bequeathher money the above way, in that case, the aforesaid Jer. B riscoe isbound to pay the aforesaid sum to the heirs of Charles Powell S eniorin an equal proportion and in the same time as above named and in order that this instrument of writing may be fully understood it isexpr essedly named and agreed by Charles Powell Senior and Sarah hiswife th at the money be paid in different payments to be made in thelifetime o f the said Sarah Powell is for her benefit and to be paidto her and he r only and no other person as long as she lives andafterwards in the m anner above named and all receipts given by herand properly attested s hall be credited but all frauds in saidreceipts liable to detection if a ny should happen. It is alsounderstood by Charles Powell and Sarah Pow ell his wife that the sumbe paid to the Sarah Powell by the aforesaid J eremiah Briscoe inconstituted of all her dower and as full compensatio n from CharlesPowell to his wife Sarah Powell and she does release the s aid Powellfrom every obligation he is under to her as a husband. In wi tness wehave here unto set our hands and seals the date within.

Charles' will said:

"In the name of God Amen, I Charles Powel of Mercer County and stateof K entucky, being in a perfect state of mind and memory but feelingthe di ssolution of my mortal body approaching, do make constitute andordain t his as my last will and testament.

First. I recommend my soul to God who gave it and my body to the eartht o be buried at the discretion of my friends in a decent manner andas t o my worldly possessions I give and dispose of them in thefollowing ma nner (to wit)

I will that all my just debts be paid and that my Negro man Tom and myN egro woman Doriah be emancipated and enjoy their freedom from andafter m y death, and that the balance of my property, both real andpersonal be s old and the proceeds of the sales be equally dividedamongst all my chi ldren having due regard to legacies they havealready received which mu st be properly accounted for as part oftheir dividends.

In testimony where of I have here unto set my hand and affixed my sealt his 27th day of March 1810.
