In the name of god amen I Honorius Powel of the County of Rockinghaman d State Virginia of perfect mind and memory but caling to mind theunce rtainty of this life and that all men must die and herebydisannuling a ll former and other wills and Testaments heretofore byme made and decl areing do make ordain Publish and declare this mylast will and testame nt, manner and form as following, that is tosay.

First and principally Being Sorry and pinetant for my Sins I commit mys ole into the hands of the Almighty god in whome and by whose mercy Itr ust to be and absurdly Believe to be Saved and my body I commit tothe e arth to be deceantly Buried by and at the discretion of myExecutors he rein after named and for the disposing of such temporalestate which it h ath pleased god to bless me with. I do give deviseand dispose of the s ame in manner and firm as following that is tosay



Firstly I give and devise to my Beloved wife Molly Powel a support ont he place that my son Honorias Powel is to have during her naturallife o r widowhood and two negros Jude and Pink with necessaries ofstock and h ousehold furniture for her use during her life orwidowhood.

Item I have given to my son Benjamin Powel and my daughter Betsy Powela t ract of land called the grape thicket which I purchased from St.Clair K irtly and that is to be their share of my landed estate.

Item I give and devise to my Daughter Fanny Powel a tract of landconta ining fifty acres more or less which I purchased from ThomasBarber lyi ng in Orange County on the side of the blue ridge to thesouth of my ho use and the larger part of the tract which I purchasedfrom Daniel Baug her containing one hundred ninety seven acres lyingon the blue ridge t o the south of the farm on which I now live andher boundary line on th e North is to run with the butter wood springbranch to her and her hei rs and the said Fanny Powel is to leave openthe road that leads to the S hiflet place so that my son Jeremiah cango and return.

Item I give and devise to my Daughter Milly Shiflet my half of thetrac t of land which I purchased from Thomas Barber and which wastaken up b y Frances Kirtley containing in the whole one hundred andfifty acres m ore or less and lying in Rockingham County on the top ofthe blue ridge , and sixty acres of a tract of land which I purchasedfrom Thomas Barb er and which was purchased by him from Philip Bushand joining the land I p urchased from Thomas Barber and which I havegiven to my Daughter Milly t o her and her heirs forever.

Item I give and devise to my two sons Robert and Chapman Powel theland w hich I purchased from Isac Smith containing by pattent onehundred and s eventy six acres lying in Orange County on the top ofthe blue ridge on t he north side of the Swift run road and all mystill tubs are to stay o n the place for the use of my two sons justabove named, to them and th eir heirs forever.

Item I give and devise to my son Jeremiah Powel the tract of landwhich I p urchased from Stephen Shiflet containing one hundred andfifty od acres l ying on the top of the mountain in Rockingham Countyto him his heirs f orever.

Item I give and devise to my son Garrot Powel the tract of land whichI p urchased from John Yansey containing about one hundred and eightyacres l ying in Rockingham County on the drain of the hawksbill creekand that p art of the tract which lies west of the mountain road whichI purchased f rom George Baugher and Nicholas Baugher executors ofDaniel Baugher Dec 'd. and a little part I swapped with James Rogersfor to him and his he irs forever.

Item I give and devise to my son Honorius Powel the tract of landwhich I n ow live on and which was Deeded to me by Joshua Bushcontaining by deed e ighty five and a half acres lying in RockinghamCounty on the top of th e blue ridge and it is my will that the beststill, all the barrels and s tand tubs for the use of my son HonoriusPowel and my wife Molly Powel s hall stay on the place and I also giveto my son Honorius Powel the two t racts which I Purchased from JamesMeddows, containing by deed ninety s even acres lying on the west sideof the blue ridge in Rockingham Count y and I also give to my sonHonorius Powel three pieces of land which a re to be taken of threedifferent tracts. First the remaining part of t he tract which Ipurchased from Thomas Barber and which he purchased fr om Philip BushSecondly the part of the tract which lies North of the b utterwoodspring and spring branch it being a smaller part of the tract w hich Ipurchased from Daniel Baugher and thirdly the part of the tract w hichlies on the east side of the mountain road which was purchased by m efrom George and Nicholas Baugher containing in the whole tract two hundred acres and one rood lying in Rockingham County on the west sideof t he blue ridge it being the remaining part of a tract which I havegiven t o my son Garrot Powel, to my son Honorius and his heirsforever.

And it is my desire that my negros Crumel and Lewis with the remainingp art of my movable estate be sold at twelve months credit and thatafter m y just debts are discharged the remaining part of the money isto be eq ually divided between my childring above named and it is mydesire that i f either of my above named childring shall die withoutan heir Lawfully b egotten of their body that their part of my abovenamed estate shall fa ll to the other of my childring to be equallydivided among them and it i s my desire that after my beloved wifeMolly Polly shall depart this li fe or marry that her estate shall besold and equally divided among my a bove named childring.

It is my desire that if the title of either of my above tracts of lands hould not be good the child to whom I have willed it shall receiveits v alue from the sales of my moveable estate. It is also my desirethat my f riend St. Clair D. Kirtley and my son Garrot Powel shall bethe executo rs to my estate. Witness whereof I have hereunto set myhand and seal t his twenty second of August in the year of our Lordone thousand eight h undred and twenty nine. This writing purporting to be thela st will and testament of Honorius Powell deceas'd was presented incour t & proved by the oaths of Absolum Shiflet & Stephen Shiflet, twowitne ss thereto & ordered to be recorded and at August Court 1830administra tion of all and singular the goods and chattles of the saidH. Powell d ec'd. was granted to Benjamin & James Powel in due formwith the said w ill annexed they having entered into bond withsecurity in the penalty o f $2000 and made oath thereto as the lawdirects and it is ordered to b e certified that Garrod Powel andSinclair D. Kirtley the exec. named i n said will refused to qualifyas ex's of said will.
