A deed dated 7/30/1889 conveyed land from his widow and 2 children tod aughter Lizzie:
"Know all men by these presents, that we Mary Whitley, widow of JohnWh itley, decd, F.M., a son of said John Whitley decd. and Nancy JaneRich ards, a daughter of the said decd, joined by her husband, J.P.Richards , having mutually agreed upon the partition of the unsoldland within t he 1/3 league of land granted to the said John Whitleydecd, as a colon ist by the Republic of Texas, situated in the Countyof Walker, State o f Texas for and in consideration of the premisesabove stated have gran ted, sold and conveyed, and by these presentsdo grant, sell and convey , unto Lizzie G. Lee a daughter of the saidJohn Whitley decd. and inte rmarried with Lewis M. Lee of the Countyof Walker and State of Texas, a ll that certain tract or parcel ofland situated in Walker County, Texa s and a part of the said JohnWhitley, one third league of land...."
