Notes for Peter B III VAN GUNDY


Info on Peter B and nephew Peter, son of Joseph, has been mixed atFindaGrave having Peter B's wife as Phoebe Speakman.

Residences & events:

1800 Mercer Co, PA, was his place of residence at census time, theonly Gundy in the county.

1810 Mahoning Twp, Mercer Co, PA. That year there was a David Gandyliving in the same area as Peter. Peter Gundy was 26-44 years of agewith a household including 2 males under 10, 2 females under 10, 3females at 10-15, 1 at 16-25, and 1 was 26-44.

1816, 1817, 1818 Green Twp, Ross Co, OH. Peter was listed there inth e state census all three years.

1830 Same place. He was 50-60 years old and lived alone. BrotherSamuel was next door followed by Peter Ring and Jacob Van Gundyfarther down the road. Other neighbers were Mays and Sidenbenders.

1840 Green twp, Ross Co, OH. At census time Peter was 60-70 yearsold . The only other person in the house was a female aged 15-20(Henrietta). Three doors down was Michael Van Gundy with Isaac andJacob 6 and 7 doors farther down.

7/31/1850 Same place. In that census Peter was 75, a farmer withreal estate valued at $3900. Living with him were young wife"Henryetta", 25 ; Charley N, 4, Francis M, 7/12, and Ring inlaws,Peter, 68, Mary, 65, Martha C, 21, along with Hamel Lewis, 13, HenryWhite, 35, and 18 year o ld Christina ?, all without occupations.

6/23/1860 Still there, PO Chillicothe. That year the census takerlisted Peter "Gundy" at age 84, a wealthy farmer with $5000/700 worthof property. Wife Henrietta was 36 and the children were Charles,14, Franklin, 11, Jerome, 8, Benner, 6, and Lafayette, 3. Also livingthere were Solomon Seymour, 23, no occupation; Elizabeth Dumond, 17,domestic; and Lewis Seymour, 14. They lived between 2 young HenrySeymour families.
FindaGrave says he was born 1775 but that conflicts with brotherSamuel b orn only 25 days earlier. Which is correct?
Peter's will, dated 8/22/1848 in Ross Co, OH & filed 3/5/1863 said:

In the Name of the Benevolent Father of all I Peter Vangundy of RosCounty Ohio do make and publish this my last will and testament:

Item 1st. I give and devise to my beloved wife Henrietta in lieu ofher dower, the farm on which we now reside, situate in Green TownshipRos County Ohio, containing about two hundred and fifty seven acres ofland, until my son Charles Nelson shall arrive at the age of twentyone years and the one third of the rents thereafter during her naturallife and all the stock, household goods, furniture, provisions andother goods and chattels which may be thereon at the time of mydecease, during her natural life, she however selling so much thereofas may be sufficent to pay my first debts.

Item 2nd. When my son Charles Nelson Vangundy shall arrive at twentyone years of age, I then give and bequeath to him in fee simple thereal estate abovementioned, he paying the one third of the rent; orvalue of the use of the land to my said wife during her natural life.

Item 3rd. In the event of my son dying before he arrived at the ageof twenty one, I give then and in that case bequeath to my said wifethe aforesaid real estate in fee simple.

Item 4th. Should there be any other heirs or heirs of my body than myson Charles Nelson, I then give and bequeath the aforesaid real estateequally divided between them, to them and to be divided when theeldest arrives at twenty one years of age.

Item 5th. It is my wish and the foregoing bequest to my beloved wifeare made in part to secure the raising, maintaining and educating ofthe heir or heirs that I may leave alive at my decease and I wish thisrequest to be faithfully performed on her part.

Lastly I do hereby constitute and appoint John Crouse executor of thismy last will and testament, hereby revoking all other wills made byme.

In testimony whereof I hereunto set my hand and seal this 22nd day ofAugust 1848.

The undersigned has been appointed Administrator of the Estate ofPeter Van Gundy late of Ross Coun by deceased.

Property set off to the widow, &C.
The followin is a schedule of property, &c belonging to the Estate ofPeter Vangundy deceased, set off by the undersigned for the support ofHenrietta Van gundy his widow and Francis Marion, Jerome, Benjamin &Lafayette Van gundy his minor children:

20 Bushels of corn in the shock at 45 cts per bushel 9.00
150 lb bacon at 7 cts per lb 10.50
and in addition thereto Two hundred & five 50/100 dollars in moneymaking in all the sum of Two hundred and twenty five dollars.

An Inventory and Appraisement of the Estate and property of Peter VanGundy late of Ross County, deceased, will be taken at Peter VanGundy's late residence in Green Township on the 14th day of March 1863and continue from day to day thereafter, if necessary until completed.Dated this 6th day of March 1863.

We Command you that you Summon Henrietta Van Gundy, Charles Nelson VanGundy, Benj Francis M. Van Gundy, Jerome Van Gundy and James L VanGundy and Fredick Bower and Joseph Bower to appear before the ProbateCourt for the County of Ross in Chillicothe, on Thursday the 3rd dayof October A.D. 1864 at ten o-clock A.M on said day to answer apetition for the sale of land exhibited against said Henrietta aswidow and Charles Nelson, Benj Francis M, Jeromy and James L Van Gundyas minor heirs and Frederik Boner and Joseph Boner as Lien holders onthe estate of Peter Van Gundy deceased by Lewis W. SiffordAdministrator upon the estate of said Peter Van Gundy deceased.andthis you shall in no wise omit under the penalty of $1,000; and havethen there this writ.

In response to the above "the total value of the personal estate andaffectfs of said decedent is as near as can be ascertained Fivehundred and seventy one dollars and forty two cents....the amount ofdebts owing by the decedent as nearly as they can be ascertainedamounts to seven hundred dollars and the amount of charges ofadministration probably fifty dollars. The personal estate andaffects are insufficient to pay said debts."

It continues by describing various land transactions:

1. 80 acres "being the same lands conveyed by Samuel Van Gundy andwife to the said Peter Van Gundy by deed bearing date July 19, 1832."
2. 20 acres conveyed by Samuel Finley to Samuel Van Gundy, then byPeter to George Maxwell bearing date December 31 1851.
3. 73 acres sold to Peter by Jacob Foy and wife bearing date March 31830
4. 2 1/4 acres sold by Peter and wife to R. M. Biggard dated april 251862.
5. 79 acres conveyed by Jacob Foy and wife to Peter dated May 10 1821

Next that Henrietta was entitled to a dower & listed all the children,still minors. Then both Bower men holding liens be made to "set forththe true amount due them on their respectiove mortgage claims.

Aug 2 1864 order to sell lands, petition against Henrietta Van Gundyand heirs to sell land filed 8/18/1864.

Then a twist:
"January 9th 1865 This writ is returned and property not offered tosale because the day set for sale is one day beyond the life of thewrit and this writ is therefore returned."

4/29/1865 Order of sale, Return of Sale & Plat of Peter Van Gundy'sland sold to Jacob Miller: 162 acres subject to Henrietta's dower wassold for $17.50/acre, total of $2835.00 which was more than herthird.. Expenses for survey, taxes, publishing, administrator fees,etc totaled $153.72.

4/1865 About or near $400 was the estimate for each of Peter's 3youngest sons as their share of the estate.

7/29/1865 John H West, John G Snyder and Wm H West paid $2500 bondfor John West to be appointed guardian of Peter's 3 youngest sonsJerome, Benj, and Laffayette Van Gundy.

Dec 31 1874 John H West filed an account as guardian of Jerome,Benjamin and Lafayette Vangundy "and further says that on the 26December 1867 he as such guardian paid the sum of $6.00 to HenriettaFolk for supporting his said wards...that he neglected to then takeher voucher for the same and sortly thereafter removed from this stateand which has prevented him from obtaining such voucher..."
